Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Maliaty mobile application and website (collectively, the "Service") operated by Maliaty ("us", "we", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1. Acceptance of Terms

By downloading, installing, or using Maliaty, you confirm that you are at least 13 years of age, have the legal capacity to enter into these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Maliaty is a personal finance management application that provides:

• Offline-first transaction tracking and budgeting (SQLite/Drift)
• Optional encrypted cloud synchronization (Firebase Firestore)
• On-device financial insights, local assistant and anomaly detection
• OCR receipt scanning and CSV bank statement import
• Savings goals with auto-deduction scheduling
• Subscription tracking and renewal alerts
• Multi-currency wallet management
• Financial Control Center with burn-rate analysis

3. User Accounts

You may use Maliaty without creating an account for fully offline functionality. To enable cloud sync, you must create an account using your email address or a supported third-party authentication provider (Google Sign-In, Apple Sign-In on iOS).

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use at support.maliaty@gmail.com.
• We reserve the right to terminate accounts that violate these Terms.

4. Free First Release

The first release is fully free, with no ads, purchases or subscriptions to Maliaty. All included tools are available without payment, including local financial insights and assistant, cash flow forecasting, receipt scanning, the Financial Control Center and data export. No personal API key or external AI subscription is required.

Subscription tracking records recurring expenses you pay to other services; it does not sell, bill or cancel those services. Their charges and cancellation terms are determined by the respective providers. Cloud chat is not available in the first release. Any future cloud AI service would require separate activation and updated privacy disclosures.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service for any illegal financial activity or money laundering.
• Attempt to reverse-engineer, decompile, or disassemble the application.
• Circumvent security features including biometric authentication or encryption.
• Use automated tools to scrape, crawl, or extract data from the Service.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the Service to harm, harass, or defraud any other person.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Maliaty and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all financial data you enter into the App. By using cloud sync, you grant us a limited, non-exclusive license to store and process your data solely for the purpose of providing the Service.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied. Maliaty does not warrant that the Service will be uninterrupted, error-free, or free of viruses.

Maliaty is not a financial advisor, bank, or licensed financial institution. The AI insights and financial projections provided by the App are for informational purposes only and do not constitute financial advice. Always consult a qualified financial advisor for important financial decisions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Maliaty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree to our collection and use of information as described in the Privacy Policy.

10. Third-Party Services

The Service may integrate with third-party services including:

• Google Firebase: Authentication and optional cloud sync. Subject to Google's Terms of Service.

We are not responsible for the content, privacy practices, or terms of these third-party services.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason including if you breach these Terms.

For account-deletion availability, identity verification and scope, see the Maliaty deletion request page and privacy and retention notice. Requests can be started by email to the approved support address on that page, subject to ownership verification. Automated deletion is not yet active. Processing deadlines and retention periods still need approval; no 30-day or complete deletion promise is made. Web deletion alone does not erase device data, exports, recovery archives or external copies.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
